(Answered) Base to Base and Hex play questions

Today my group encountered some situations in Alpha Strike hexed play.
Most of these concerned "base to base" contact, via adjacent hexes.
With that in mind, we've collected a pair of questions for you to answer out if possible.

1. What if you are hex adjacent, but terrain will not allow a physical attack?
Example: I'm on a level 5 and he's on a level 0. Technically we can't physically attack due to the height, but rules state that's all we can do.

2. Another situation occured when a Kopis was adjacent to a Mech.
The Kopis does not have any Anti Mech specials, so that means by the rules of the adjacent hex it can only perform anti Mech attacks.

Since it doesn't have that special, what could we do?

Base to base Contact in hex play has been errated, now, to specify the units must be within 1 level of elevation of each other to qualify for base to base contact. 

We're reviewing base to base contact and no weapon attacks in hex play, but for now, the Kopis cannot attack an adjacent unit, same as a combat vehicle.
