VTOL at level 1 fires against a vehicle at level 0. Distance is 2 hexes. Vehicle is behind a level 1 terrain and the LOS cross this level 1 hex.

Does the VTOL have valid LOS to the vehicle?

If the VTOL is at level 2+ does it make any difference? If the VTOL is at more distance (3+ hexes) does it make any difference?

The VTOL does not have LOS, because the vehicle is 1 level high and next to a Level 1 terrain feature.  This triggers point 3 on p. 100, TW.  The height of the VTOL is irrelevant here.
